Terms of Service

1. About these terms
These Terms of Service govern access to and use of the CG1 website, FairPlay Graphics, RingSide Graphics & Data, their tenant workspaces, control and render pages, integrations and related user-facing features (together, the Services) operated by Start Webcast Pty Ltd (Start Webcast, we, us or our). By accessing or using the Services, you agree to these terms. If you use the Services for an organisation, you confirm that you have authority to bind that organisation.
2. Eligibility and accounts
You must be legally capable of entering a binding agreement and must provide accurate, current information. You are responsible for protecting your login credentials, controlling access to public control or render links, and promptly notifying us of suspected unauthorised use. Activity performed through your account or tenant workspace is treated as authorised by you unless you tell us otherwise.
3. Tenant access and authorised users
Access may be assigned by platform or tenant administrators. Administrators are responsible for assigning suitable permissions, removing users who no longer require access and ensuring that shared links are distributed only to intended operators. You must not access another tenant, game or production unless authorised.
4. Acceptable use
You must use the Services lawfully and must not:
- infringe another person's rights, confidentiality, privacy or intellectual property;
- upload, transmit or process unlawful, harmful, deceptive or malicious content;
- interfere with the security, availability, timing or operation of the Services;
- attempt unauthorised access, scraping, reverse engineering or circumvention of technical limits, except where the law permits it;
- use control, scoring or graphics functions to deliberately publish false, unlawful or misleading material; or
- use the Services to distribute malware, spam or facilitate unlawful conduct.
5. Production use and operator responsibility
The Services assist with live graphics, scoring, timing, data display and production workflows. You remain responsible for checking game configuration, scores, clocks, names, logos, external feeds and outputs before and during a production. You should maintain suitable operational procedures and fallback arrangements for live events. The Services are not an official sporting adjudication system unless a separate written agreement expressly says otherwise.
6. Connected services and external data
You may choose to use Microsoft or Google sign-in, XML or other data-provider feeds, cloud storage, spreadsheets or other third-party services. You authorise us to access and process connected data only to provide the feature you or your administrator configure. Third-party services remain subject to their own terms, security and availability. You are responsible for ensuring that you have permission to connect and use each data source.
7. Your content and production data
You retain ownership of content and data you submit, import or connect, including competition, game, participant, team, venue, logo, scoring and media data. You grant Start Webcast a limited, non-exclusive licence to host, copy, transform, transmit, back up and process that content only as reasonably necessary to operate, secure and provide the Services. You confirm that you have all rights and permissions required to provide and broadcast that content.
8. Our intellectual property
The Services, software, website content, graphics templates, branding and materials supplied by us are owned by or licensed to Start Webcast. Except as expressly permitted, you may not reproduce, modify, distribute, resell or commercially exploit them without prior written consent.
9. Service availability and changes
We may maintain, update, change or discontinue parts of the Services. We aim to provide reliable operation but do not promise uninterrupted, delay-free, error-free or completely secure service. We may suspend access where reasonably necessary for security, maintenance, legal compliance, capacity management or suspected breach of these terms.
10. Fees and commercial engagements
Any subscription, production, engineering, equipment hire, support or professional-service fees are governed by the applicable proposal, order form or separate agreement. If there is an inconsistency, that specific written agreement prevails for the relevant engagement.
11. Consumer guarantees
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded, including under the Australian Consumer Law. Where the Australian Consumer Law permits us to limit liability for a failure to comply with a consumer guarantee, our liability is limited, at our option, to supplying the relevant services again or paying the cost of having them supplied again.
12. Disclaimers
To the maximum extent permitted by law, the Services are provided on an “as available” basis. Automated outputs, imported data and third-party feeds may be delayed, incomplete or inaccurate. You remain responsible for reviewing and approving information shown through the Services and for decisions made using that information.
13. Liability
To the maximum extent permitted by law, Start Webcast is not liable for indirect, incidental, special or consequential loss, loss of profit, revenue, opportunity, goodwill, production output or data arising from use of the Services. Any liability that cannot be excluded will be reduced to the extent that your act or omission contributed to the loss. This clause does not limit liability where doing so would be unlawful.
14. Indemnity
To the extent permitted by law, you indemnify Start Webcast against third-party claims, losses and reasonable costs arising from your unlawful use of the Services, your content, or your material breach of these terms, except to the extent caused by our negligence, unlawful conduct or breach.
15. Suspension and termination
You may stop using the Services at any time. We may suspend or terminate access for a material breach, security risk, unlawful use, non-payment under an applicable commercial agreement, or where required by law. Provisions intended by their nature to survive termination, including intellectual property, liability and dispute provisions, continue to apply.
16. Privacy
Our Privacy Policy explains how we handle personal information associated with the Services.
17. Changes to these terms
We may update these terms from time to time. We will publish the revised terms and update the effective date. Where a change materially affects your rights, we will take reasonable steps to provide notice.
18. Governing law
These terms are governed by the laws of New South Wales, Australia. Subject to any non-excludable rights, the parties submit to the courts of New South Wales and courts entitled to hear appeals from them.
